Who Qualifies for VA Loans ?

 

To be able to get a VA home loan you will need to complete the Certificate of Eligibility VA Form 26-1880  (http://images.military.com/Data/MIB/Finance/Content/Files/form_26-1880.pdf-Lynn can you take the image on this page and make it a page for va-loan.org?  The Veterans Administration is the only group that can issue your VA Certificate of Eligibility.  You could qualify for the certificate if you are one of the following.

ü  If You Active Duty Personal

ü  A Veteran

ü  Reserve or National Guard

ü  Military Spouses (please speak to your VA Lender about being eligible)

Eligibility for the VA Certificate is granted based on yours, or your spouse’s, military service history. The Certificate is required to get your VA Loan; however, it is only the first step.  In order to obtain your home loan you will need to apply and be approved by a lender that specializes in VA Loans.

The eligibility is established by Congress.  There are several common instances where you could qualify for a Certificate of Eligibility.

  1. 1.       If you served after 09-07-1980 (if you were enlisted) or 10-16-1981 (if you were an officer)
  2. 2.       Wartime Service – See below for times of service-
  • World War II: 09-16-1940 through 07-25-1947
  • Korean War: 06-27-1950 through 01-31-1955
  • Vietnam War: 08-05-1964 through 05-07-1975

Note: You will have to have at a minimum of ninety (90) days in which you were on active duty and also you have been discharged which is not under dishonorable conditions (dishonorable discharge).  You may be eligible if you served less than ninety (90) days if you were discharged for a disability connected to your time in service (service connected disability).

  1. 3.       Peacetime Service:  For the following dates of service-

ü  07-26-1947 through 06-26-1950

ü  02-01-1955 through 08-04-1964

ü  05-08-1975 through 09-07-1980 (If you were enlisted)

ü  05-08-1975 through 10-16-1981 (if you were an officer)

Note: It’s important to note that you must have served at a minimum of 181 days (with continuous active duty) plus you need to have been discharged which is not under dishonorable conditions (dishonorable discharge).  You may be eligible if you served less than (181) days if you were discharged for a disability connected to your time in service (service connected disability).

  1. 4.       If you served after 09-07-1980 (you were enlisted) or if you served after 10-16-1981 (you were an officer)

Note: You have to meet the following guidelines if you were separated from serving in the military (if you began serving after the above dates)

  • You will have needed to complete Twenty Four (24) months of continuing active duty (it needs to be at least 181 days) and also you have been discharged which is not under dishonorable conditions (dishonorable discharge). or…
  • You will have needed to complete at a minimum 181 days of continuing active duty and also you will have to of been discharged under specific authority of what is titled “10 USC 1173 (Hardship)”, or “10 USC 1171 (Early Out)”.  Also you could have been determined to have the following “compensable service-connected disability”
  • You will have needed to have been discharged with less than 181 days of service in which you were discharged for a service connected disability.  There is the ability to also be eligible if you were released from active duty which was a result of an “involuntary reduction in force” (certain medical conditions are acceptable to meet this requirement).

 

  1. 5.       If you served in the Gulf War- (Note) The Times of Service are for the following periods 08-02-1990 through (the end date has not been determined yet)

Note: To be eligible if you served on active duty during the Gulf War you will have to meet the following guidelines:

ü  You will have needed to complete Twenty Four (24) months of continuing active service duty or the full period (which is considered Ninety (90) days) which you were ordered or called to be in active duty.  Also, you need to have been discharged which is not under dishonorable conditions (dishonorable discharge). or…

ü  You will of needed to have completed at least Ninety (90) days of active duty and you will of needed to have been discharged under specific authority of what is titled “10 USC 1173 (Hardship)”, or “10 USC 1171 (Early Out)”.  Also you could have been determined to have the following “compensable service-connected disability”. or…

ü  You will have needed to have been discharged with less than Ninety (90) days of service in which you were discharged for a service connected disability.  There is the ability to also be eligible if you were released from active duty which was a result of an “involuntary reduction in force” (certain medical conditions are acceptable to meet this requirement).

 

  1. 6.       National Guard or Selected Reserves –

Note: It’s important to know that If you are not otherwise eligible and you have completed a total of six (6) years in the National Guard or Selected Reserves (being that you have attended the required weekend drills and two (2) week duty for training (being a member of an active unit)  (plus)…

  • You were placed on list as retired,  or…

 

  • You were transferred on an element of “Ready Reserve” or were transferred to “Standby Reserve” which is other than the “Selected Reserve” after service was characterized as an “honorable service”, or…
  • You were discharged and received an “honorable discharge”, or…
  • You are now in the Selected Reserves.  (you are still active)

Note: You also could be determined to be eligible if you meet the following requirements.

ü  It’s important to note that you may also be eligible if you served less than six (6) years and you were discharged for a “service-connected disability”, or…

ü  You are not remarried and you are a spouse of a veteran that died while he or she was in service or if he or she died from a service connected disability, or…

ü  You also may be eligible if you are a spouse of a service member which who were missing in action or a prisoner of war (POW)

 

  1. 7.       If You Are Active Duty-

Note: If you are currently on “regular duty”, if you are not on active duty for training, then you are able to receive eligibility after you have served 181 days (this needs to be 90 days during the Gulf War) unless you were separated or discharged for a previously qualified time period in which you were active duty.

  1. 8.       VA Eligibility may also be Established for the Following Individuals –

 

  • If you have service as a member in certain approved organizations (ex.) Cadets at the United States Military, Public Health Service Officers, Coast Guard or Air Force Academy, midshipmen in the United States Naval Academy, merchant seaman with WW II Service, officers of National Oceanic & Atmospheric Administration, and others too.
  • Also, some United States Citizens in which served as an ally in the armed forces with the United States in WW II.
